Our approach

ArsenalBase respects intellectual property and expects members to do the same. We respond to notices of claimed infringement that follow the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Filing a takedown notice

Your notice must include:

  1. your physical or electronic signature (or that of someone authorized to act for the copyright owner);
  2. a description of the copyrighted work you believe was infringed (or a list, if several works are covered by one notice);
  3. the link to each post, photo or Vault page on ArsenalBase that contains the material, with enough detail for us to find it;
  4. your name, mailing address, phone number and email address;
  5. a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law; and
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Notices missing these elements may not be valid. When we receive a valid notice, we remove or disable the material and let the member who posted it know, including a copy of the notice.

Where to send it

Send notices to our designated copyright agent:

[Designated agent name]

Unicorn Powered, LLC d/b/a ArsenalBase
901 N Brutscher St, STE D #164, Newberg, OR 97132
copyright@arsenalbase.com

This address is only for copyright notices. Other questions go to support@arsenalbase.com.

Counter-notices

If your content was removed and you believe it was a mistake or a misidentification, or that you have the right to post it, you can send a counter-notice to the same address. It must include:

  1. your physical or electronic signature;
  2. a description of the removed material and the link where it appeared;
  3. a statement, under penalty of perjury, that you have a good faith belief the material was removed by mistake or misidentification;
  4. your name, mailing address and phone number; and
  5. a statement that you consent to the jurisdiction of the federal district court for your address (or, if you’re outside the US, any judicial district where ArsenalBase may be found), and that you will accept service of process from the person who sent the original notice.

When we receive a valid counter-notice, we send a copy to the person who filed the original notice. Unless they tell us within 10 business days that they have filed a court action to keep the material down, we may restore it 10 to 14 business days after receiving your counter-notice.

Repeat infringers

We close the accounts of members who repeatedly infringe others’ copyrights, in appropriate circumstances.

False claims

Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you aren’t sure whether something infringes your rights, consider talking to a lawyer before sending a notice.

Trademarks and other rights

For trademark concerns, such as a handle or display name that impersonates a brand, or other intellectual property issues, email legal@arsenalbase.com with the details and a link to the content.
